The New Jersey Department of Education (NJDOE) guidance confirms that school districts may not legally require waivers of rights or consents to delivery of virtual services as a condition for the delivery of special education or related services during this COVID-19 public emergency. The guidance states that the districts’ actions in requiring these waivers or consents violate IDEA and NJDOE regulations. A true win for parents and children.
