Dorothy A. Kowawas invited to speak at the Complete Streets Seminar at Waterloo Village in Byram Township, New Jersey, on March 31, 2011. The seminar is presented by the Counties of Sussex, Morris and Warren and will address the implementation of the Complete Streets Policy recently adopted by the New Jersey Department of Transportation. In accordance with this policy, those planning, designing, constructing and/or maintaining projects on state roads, or who will be using Capital Program funds, must give the same consideration to the needs of all users, including bicyclists and pedestrians, and transit users of all ages and abilities, as they have traditionally given to motor vehicle operators. New Jersey is at the forefront of a national trend in which communities are attempting to design projects that will result in safer, more accommodating, and more livable neighborhoods, reduce traffic congestion and promote healthier lifestyles. Ms. Kowal will address the legal implications as well as the liability concerns of the counties in implementing the complete streets policy.

Dorothy A. Kowal has been invited to speak at the upcoming NJ Complete Streets Summit at Rutgers University – New Brunswick, on October 22, 2010. The Summit is presented by the New Jersey Department of Transportation and the Voorhees Transportation Center, with funding from the Federal Highway Administration, cosponsored by the NJ Chapter of the American Planning Association. The Department of Transportation recently adopted a Complete Streets Policy, and would like to help spread the word about this program, encouraging more counties and municipalities to adopt their own policies. Ms. Kowal will provide an overview of local government responsibility and legal protections from liability as expressed in the law and in case law in implementing the complete streets policy.

Gail L. Price was again included in this year's Fourth Annual Real Estate New Jersey "Women of Influence". Gail was one of 20 female professionals honored for their achievements in the commercial real estate industry. She is co-chair of the Bergen Bar Association's Land Use section and has recently been victorious in several influential litigation cases for commercial developments, many involving new case law.

Greg Meese Scores Significant Victory for Parental Rights. On June 11, 2010, an Administrative Law Judge found the Ramapo Indian Hills Board of Education’s Conduct Away From School Policy to be unconstitutional. In a case handled by Greg Meese, the Judge found that the policy, which would require the suspension of students from participation in extracurricular activities for any violation of the New Jersey Code of Criminal Justice and/or applicable municipal code, to violate the student’s parents’ parental rights protected by the Fourteenth Amendment to the United States Constitution and to be beyond the authority of the Board of Education.

The Judge noted that the United Supreme Court has found that the “liberty interest at issue – the interest of parents in the care, custody, and control of their children – is perhaps the oldest of the fundamental liberty interests.” The decision notes that the authority of a school district over students is subject to limitations, and where a school’s policies come into conflict with the fundamental right of parents to raise and nurture their child, the primacy of the parents’ authority must be recognized and should yield only where the school’s action is tied to a compelling interest.

The authority of a board of education applies to student conduct on school grounds and at various school-sponsored functions. For conduct away from school grounds such authority is limited to situations where it is “reasonably necessary for the student’s physical or emotional safety, security and well-being or for reasons relating to the safety, security and well-being of other students, staff or school grounds.”

The Judge found that “dealing with charges against a teenager unrelated to school is the proper function of the parents without interference from school authorities.” A school district “has no authority whatsoever to enforce, determine guilt or otherwise impose a consequence for alleged violations (or violations) of the New Jersey Code of Criminal Justice and/or applicable municipal codes or ordinance provisions.”

The Ramapo Indian Hills policy was found to be “grossly overbroad” and therefore unconstitutional, illegal, and unenforceable. A copy of the decision in G.D.M. and T.A.M., on Behalf of Minor Child, B.M.M. v. Board of Education of the Ramapo Indian Hills Regional School District, Bergen County, is available upon request.

Louis L. D’Arminio was an invited speaker at the first Vision Bergen: Blueprint for Our Future Symposium at the Mahwah Sheraton on May 18, 2010. As part of a renewal effort, the County has created a “visioning” process to foster further discussion of key quality-of-life issues in Bergen County. Over 350 members of the greater Bergen County community attended. Lou spoke at one of the workshops about various approaches to overcoming New Jersey’s staunch home rule ethic to ensure that, in addition to the standard local review, larger-scale developments are afforded a process that addresses their regional impacts as well.

The Saddle Brook Special Education Parent Advisory Committee invited Karen F. Edler and Katie Razin to present the “Navigating the Alphabet Soup of Special Education” seminar at their meeting on Thursday, April 29, 2010 at the Saddle Brook High School/Middle School Media Center. The presentation included an overview of the Individuals with Disabilities Education Improvement Act of 2004 (“IDEA”) and the New Jersey Administrative Code education regulations which implement IDEA in New Jersey. Ms. Edler and Ms. Razin provided the parents with strategies for effective advocacy to obtain a free, appropriate public education in the least restrictive environment appropriate for their child. Participants at the seminar were provided with a free pamphlet encompassing the information presented during the seminar and providing additional information and resources to assist them in understanding the rights provided under the special education laws.

Paul Conciatori will be participating as a member of the regulated community in a joint New Jersey Department of Environmental Protection/stakeholders team advancing the effectuation of the recently enacted Site Remediation Reform Act. The team will be evaluating priority issues presented in the first months of implementation and exploring measures to provide additional information and clarity to the regulated community.

On March 4, 2010, Karen F. Edler and Kathryn J. The Bergen County Council of Irish Associations has selected Michael Breen to be an Honorary Grand Marshall for the 2010 Bergen County St. Patrick’s Day Parade. The Bergen County Parade, one of the largest in New Jersey, will march on Sunday, March 14, in Bergenfield.

Adrienne Zitka has achieved the designation of LEED AP (Leadership in Energy and Environmental Design Accredited Professional) from the U.S. Green Building Council. LEED is the nationally accepted benchmark for the design, construction, and operation of high performance green buildings. The LEED AP designation distinguishes professionals who have demonstrated the knowledge and skills to successfully steward integrated design with the LEED certification process.

Greg Meese completed work on the 2009 Land Use Citator, a compendium of case summaries and newly enacted statutory and regulatory law that impact land development. The New Jersey Institute of Continuing Legal Education will publish the Citator in March 2009.

The Forty Under 40 awards program honors men and women under the age of 40 who have been making headlines in their field and who share a commitment to business growth, professional excellence, and their community. NJ BIZ and the program sponsors honored this year’s forty winners during an awards ceremony on September 22, 2008 at the Palace at Somerset Park in Somerset, New Jersey. Winners were also highlighted in a special supplement to NJ BIZ magazine on September 29, 2008.

Plans are underway for the 26th Annual March of Dimes Harvest Ball, which will be held on Friday, November 14, 2008 at the Woodcliff Lake Hilton. Gail Price and Katie Razin are serving on the Planning Committee, with Gail as Chair. This year’s event honoree is Dr. Peter P. Mercer, who is the President of Ramapo College of New Jersey. The mission of the March of Dimes is to improve the health of babies by preventing birth defects, premature birth, and infant mortality. The event has raised almost $4 million for the charity.

Louis D’Arminio, Dawn Budris, Damaris DeBlasio, and Richard Fricke participated in the Susan G. Komen Race for the Cure in New York City on Sunday, September 14. Prior to walking in the event, the PMSD team raised money for this charity which works to find a cure for breast cancer.

A team of walkers from PMSD will participate in the Making Strides Against Breast Cancer walk on Sunday, October 26th in Paramus, New Jersey in conjunction with the American Cancer Society. Team members walking in this fundraising event so far include Gail Price, Mary Michelmore, Richard Fricke, Mary-Pat Porcelli, Louis D’Arminio, Jennifer Knarich and Katie Razin.

Katie Razin and Jennifer Zeller participated in the Annual Glen Rock Jaycees Labor Day Arboretum Run. The pair finished the five-mile run together with a time of 44:41. The Jaycees are a service organization in Glen Rock actively involved in the community by providing support to organizations such as the Volunteer Fire Department and Ambulance Corps.

Gail Price recently participated in the Paterson Habitat for Humanity Lowe’s Women Build event for a home located on North 1st Street in Paterson, New Jersey. During the event, Ms. Price worked on a “raise the wall” afternoon along with a group of motivated Women Build volunteers. Women Build homes are constructed and partially financed by women volunteers.

Simone Sinisi was accepted for the 2008-2010 term of the Justice Morris Pashman American Inn of Court. The Justice Morris Pashman Inn was founded as one of the first Inns of Court in New Jersey and was created by a group of dedicated Judges and attorneys for the purpose of teaching and mentoring young lawyers in the skills of trial advocacy, civility, professionalism and ethics.

Breen was among a delegation representing major Irish-American organizations who met with Owen Paterson, MP, Britain’s Secretary of State for Northern Ireland, at the British consulate in New York City. The delegation and Mr. Paterson discussed issues related to the peace process in the north of Ireland.

Michael K. Breen was the moderator for an international panel of speakers discussing sectarianism and conflict resolution in the north of Ireland. The panelists gathered at the Irish American Unity Conference’s twenty-fourth annual national convention in Boston, Massachusetts. The panelists included a senior lecturer from Queen’s University, Belfast, and a representative from the Belfast City Council. The Irish American Unity Conference is a national, non-profit organization working for peace with justice in a reunited Ireland.

Lou has been representing outdoor advertising companies for over twenty-five years, has lectured on outdoor advertising both state-wide and nationally, and is recognized as one of the foremost land use authorities in the field.

Gail L. Price - Plans are under way for the 25th Annual Harvest Ball for the March of Dimes to be held on November 2, 2007. Ms. Price serves as chair for the black tie gala and was recently presented with the Volunteer of the Year Award by the North Jersey Chapter of the March of Dimes. Gail’s commitment and contributions to the charity were recognized by state and national representatives at a volunteer recognition dinner in Princeton. She is the former Chair for the Board of Directors for the North Jersey Chapter and has served on the State Board as well. Her daughter Mackenzie was the National Ambassador for the charity in 2000.

Michael K. Breen was one of four judges for the New Jersey phase of the international Rose of Tralee competition, which was held at the Park Ridge Marriott ballroom in Park Ridge, New Jersey. The Rose of Tralee competition celebrates modern young women and their aspirations, ambitions, intellect, social responsibility and Irish heritage. The New Jersey winner will compete for the Rose Crown during the annual Rose of Tralee International Festival in Tralee, County Kerry, Ireland, in August 2007.

Gregory Meese has been named Editor of the Land Use Citator published by the New Jersey Institute of Continuing Legal Education. The Citator is a compendium of Land Use Cases, both reported and unreported, that will be updated annually. It was named ICLE's Book of the Month for April 2007. Gregory Meese and Louis D'Arminio spoke at the 2007 Land Use Update sponsored by the New Jersey Institute for Continuing Legal Education. January 2007 The firm’s sponsored dodgeball team, the “Adverse Possessors”, launched their inaugural season in a local recreational league. This co-ed team, consisting of recruits drawn from the firm’s employees and their spouses and friends, will spend the next six Sundays playing round-robin type, multi-team tournaments in Manhattan. Half of all league fees and a portion of post-game happy hour expenditures are donated to charity. The Adverse Possessors are playing to benefit The October Woman Foundation, a local breast cancer research organization.

Kathryn J. Razin served as a judge at the Mock Trial Competition held at the Bergen County Courthouse. Local high school students who win the county-wide competition go on to compete in the state finals, which lead to the national competition. September 2006 Adrienne Zitka has joined the firm as a law clerk while she awaits the results of the bar exam. After attending Muhlenberg College, where she graduated Phi Beta Kappa, Magna Cum Laude, and Morris K. Udall Scholar, Ms. Zitka earned her law degree from Rutgers University School of Law. While in law school, she was the Notes editor of the Journal of Law and Policy and author of "Road Work Ahead: Slow Down. What about public transit?: The Future of the Transportation Equity Act for the 21st Century." Also during law school, Ms. Zitka, a resident of Hasbrouck Heights, New Jersey, participated in Rutgers' Community Dispute Resolution pro bono clinic and its Immigration Law pro bono clinic.

Mary Anne Iuliano has joined the firm as an associate. Prior to joining Price Meese, she was an associate in the corporate and commercial department of a prominent northern New Jersey law firm. Ms. Iuliano's professional experience also includes work as an auditor for Ernst & Young. Ms. Iuliano graduated from Clemson University with a Bachelor of Science in Marketing and a minor in Accounting. She received an MBA from Georgia State University with a major in Accounting and graduated with honors from Emory University School of Law. Ms. Iuliano practices in the area of commercial real estate and corporate law.

Gail L. Price was elected President of the Lehigh University Alumni Association for the 2006-2007 year. In that role, she will serve on the Executive Committee for the Board of Directors, an advisory board which assists the Alumni Association staff in strategic planning to ensure that the activities and programs of the Association are implemented in accordance with the mission of the organization. Over the next 12 months, Ms. Price will be busy working with other Board members and representatives of the University to ensure that the mission of the Association—“to maintain and cultivate among its members a sentiment of regard for one another, an affection and attachment to Lehigh University, and to support and promote in every way the interests of Lehigh University” – is best represented and carried forward to the 51,000 alumni of the University. I am also continuing this year as a member of the Advisory Council for the College of Arts and Sciences at Lehigh University.

Ms. Ronayne has completed her first year of law school at Seton Hall University School of Law and is a 2005 graduate of the University of Delaware, where she received her Bachelor of Arts in Political Science with a concentration in American Politics. While at the University of Delaware, Ms. Ronayne was a Dean's List scholar and a member of Pi Sigma Alpha National Political Science Honors Fraternity.

Balpreet Virk of Mahwah, New Jersey has returned to the firm as a summer law clerk after serving as an undergraduate intern in 2003. Ms. Virk has completed her first year of law school at Michigan State University and is a 2004 graduate of Seton Hall University, where she majored in Criminal Justice and was a member of the Seton Hall Association of Indians. Ms. Virk is an aspiring golfer so look for her on the greens this summer.

Gail L. Price was elected as a Trustee for the Bergen County Bar Association. She was sworn in and began her term at the Association’s Annual Beefsteak Dinner held at the Hasbrouk Heights Hilton. Gail L. Price is serving as Co-Chair for the Land Use Committee for the Bergen County Bar Association and will be serving as moderator for the Annual Land Use Symposium. The event is scheduled for Saturday, April 29, 2006 at Bergen Community College in Paramus and is being offered to board members in fulfillment of their certification requirement. Advance registration exceeds 300 participants from municipalities across the county.

Elliott L. Pell has joined the firm as Of Counsel. Mr. Pell has over twenty-five years of experience litigating cases in state and federal courts in numerous states. He is admitted to practice in New Jersey, New York and before the United States Disctrict Court, Disctrict of New Jersey, the United States District Court, Eastern District and Southern District of New York, the United States Court of Appeals for the Third Circuit, and the United States Court of Appeals for the Second Circuit.

Gregory Meese, former Chairman of the Board of Directors of the New Jersey State Bar Association Land Use Law Section, will be moderating and speaking at a seminar on October 29, 2005, for the New Jersey Institute for Continuing Legal Education. The seminar is entitled “Practicing Before Land Use Boards."

Gail L. Price received the Bergen County Bar Foundation's 2005 Lawyer-Achievement Award, bestowed annually to the attorney whose efforts have significantly improved the quality of life for citizens of Bergen County. Ms. Price was presented with the award at the Foundation's Annual Awards Dinner on September 26 in Mahwah, New Jersey.

Kim Walters Greene passed the Certified Legal Assistant (CLA) examination given by the National Association of Legal Assistants, Inc. in July, 2005 and has earned the designation of Certified Paralegal ("CP".) Kim is one of only 75 paralegals in New Jersey who have earned this designation and are entitled to use the "CP" professional credential.

Michael K. Breen recently conducted a three-part seminar series on commercial leasing at the Saddle Brook, New Jersey, office of CB Richard Ellis, the global real estate services firm. Michael lectured on the topic of "Hot Lease Issues & Effective Compromises."

Michael Breen participated in the Hon. Nicholas G. Mandak Charitable Foundation Annual 5K race in Wayne, New Jersey. The Foundation is administered by the Passaic County Bar Association and provides scholarships to needy students. Michael served as a law clerk for the late Judge Mandak.

Price, Meese, Shulman & D'Arminio, PC attended the "Lawyering in the Public Interest Benefit 2005" on February 23, 2005 sponsored by the Essex County Bar Association and Seton Hall Law School. The benefit raised money to provide financial assistance to law students who practice public interest law after graduation.
